Waiver of Liability & Training Terms

1. Assumption of Risk

Participation in basketball training and related Activities involves inherent physical risks. Participants (and parents/guardians of minor participants) voluntarily assume all such risks, including but not limited to:

• Sprains, strains, fractures, and other musculoskeletal injuries
• Concussions or other head/neck injuries
• Cardiovascular events related to physical exertion
• Injuries caused by contact with other participants, equipment, or facility surfaces
• Heat-related illness, dehydration, or exhaustion
• Any other injury arising from athletic participation

These risks are assumed whether or not foreseeable at the time of participation.

2. Release of Liability

Participants and parents/guardians of minor participants RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE No Days Off Training LLC, its owners, officers, coaches, trainers, employees, agents, volunteers, sponsors, and affiliated parties (collectively, “Released Parties”) from any and all claims, demands, losses, damages, causes of action, or liabilities of any kind — including those arising from negligence — resulting from participation in any NODAT Training Activity. This release applies to injuries sustained before, during, or after any session, camp, clinic, or event, whether on or off the training facility premises.

3. Indemnification

Participants and parents/guardians agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS the Released Parties from any and all claims, actions, damages, liability, and expenses — including attorneys’ fees — arising from participation in NODAT Training Activities or any breach of these terms.

4. Medical Fitness & Health Disclosure

By enrolling, participants represent that they (or the minor participant) are in good physical condition and have no known medical conditions, injuries, or disabilities that would prevent safe participation in basketball training. Participants agree to inform NODAT Training of any changes in health or medical status that may affect participation.

5. Medical Authorization

In the event of a medical emergency during any NODAT Training Activity where a participant or parent/guardian cannot be reached, NODAT Training and its representatives are authorized to seek emergency medical treatment on the participant’s behalf. Participants agree to be financially responsible for any medical expenses incurred.

6. Payment & Refund Policy

All session fees, camp registrations, and program payments are non-refundable unless otherwise stated in writing by NODAT Training.

• Cancellations made with less than 24 hours notice may result in forfeiture of that session
• No-shows without prior notice will be charged in full
• NODAT Training reserves the right to reschedule sessions due to facility or coach availability
• Refund exceptions are made at the sole discretion of NODAT Training management

7. Code of Conduct

All participants are expected to conduct themselves in a respectful, sportsmanlike, and safe manner at all NODAT Training Activities. NODAT Training reserves the right to remove any participant — without refund — for conduct deemed unsafe, disrespectful, or disruptive to other participants, coaches, or staff.

8. Photo & Video Release

Participants (and parents/guardians of minors) grant No Days Off Training LLC permission to photograph, film, or record their likeness during NODAT Training Activities and to use such content for marketing, promotional, educational, and social media purposes without compensation. Participants who do not consent must notify NODAT Training in writing prior to participation.

9. Governing Law & Severability

These terms are governed by and construed in accordance with the laws of the State of New York. Any disputes are subject to the exclusive jurisdiction of the courts of the State of New York. If any provision is found unenforceable, the remaining provisions continue in full force and effect.
